Are large legal publishers shooting themselves in the foot when it ...

Attorney and media consultant, Bob Ambrogi, has a post this morning reviewing Thomson Reuters new site covering the Supreme Court?s 2011-2012 term, called Case by Case: The U.S. Supreme Court. The site is part of Thomson Reuters' (owner of Westlaw) push into enhanced legal coverage through the web.

Bottom line Ambrogi says if you want snappy visuals the Thomson Reuters site is for you, but if you are looking for substantive information, look elsewhere.

The site uses interactive graphical tools to help users find information about the court, the justices and the cases, with links to analytical and legal materials, including motions, briefs and opinions. While the graphical elements hold the promise of being useful, the site?s usefulness is quickly lost for anyone who does not have a Westlaw subscription.

...Although the site provides links to briefs, decisions and various other documents, all links lead to Westlaw. If you want to see the petitioner?s brief in a case, you?ll need a Westlaw subscription. If you want to see the court?s decision in a case, you?ll need a Westlaw subscription.

If any of this were content proprietary to Westlaw, I might understand this set up. But many if not most of these documents are publicly available online. The Supreme Court?s opinions are available directly from the court itself, as well as from any number of other sites. Briefs are available from the American Bar Association?s stellar site, Preview of United States Supreme Court Cases. All sorts of background and commentary are available from the preeminent Supreme Court source, SCOTUSblog.

Joe Hodnicki, an excellent blogger at Law Librarian Blog, described the site as "...[A]nother corporate avenue to promote subscribing to Westlaw to access cited content.?

Thomson Reuters may not be alone in this tease and up sell approach.

I've been watching Wolter Kluwers, another of the large legal publishers, approach to new media. They have a number of blogs such as the Kluwer Patent Blog and the Kluwer Arbitration Blog.

The contributors appear to be lawyers and scholars that have historically written for Wolter Kluwers publications. Though the content may be of substance, there is little engagement on the author's part (something it takes to be a good blogger) and I don't see their bloggers or blogs cited on other blogs by the legal community as a whole nor the content being shared via social media ala Twitter and LinkedIn.

On the top of each blog is a bold link to 'Related Sites.' The related sites appear to lead to resources which require a subscription to Wolter Kluwer resources.

From one of Wolter Kluwer's sites I was drawn to a "Manual IP iPad app," which complements KluwerManualIP.com, an online version of their Manual for the Handling of Applications for Patents, Designs and Trademarks.

The app is little more than bulleted news headlines, which when clicked on takes you to a page where you can begin a free trial subscription of Kluwer's Manual IP.

I don't begrudge Thomson Reuters/Westlaw or Wolter Kluwers for wanting to sell subscriptions to their services. But to get into the blogging, new media, and app game as a fox in sheep's clothing is likely to backfire.

Current subscribers may find the new forms of access helpful, but such an approach can turn off the legal community as a whole and do more harm than good to your brand.

Hodnicki and Ambrogi are heavy hitters when it comes to influencing the legal community. Getting them to belittle your product and imply it's a scam to get lawyers to pay is not something you want to do. Unlike info from your new site or resource, Hodnicki's and Ambrogi's views are being sited and shared across the Internet.

A better approach for large legal publishers may be to support, sponsor, or partner with new media publishers who have figured out, through trial and error, how blogging and social media work.

Look at SCOTUSblog. It was started in 2003 by Attorney Tom Goldstein, before he had even made a name for himself as an advocate before the Supreme Court of the United States. Goldstein poured his heart and soul into providing a free and valuable resource on the Supreme Court.

Not only did SCOTUSblog become the most widely-read publication covering the Supreme Court, but it launched Goldstein's career.

Rather than launch a site competing with SCOTUSblog, Bloomberg Law entered into a an exclusive sponsorship of the blog this fall. From Bloomberg Law Chairman, Lou Andreozzi, former CEO of LexNexis:

SCOTUSblog?s comprehensive and impartial examination of the Supreme Court is an important public resource and Bloomberg Law is proud to support their ability to bring this content to the public, free of charge via the Web.

Large legal publishers would be well advised to take more of the Bloomberg approach.

First, though there's likely to be a role for professionally reported and edited legal news and information, you can simply not cover all the niches and nuances that practicing lawyers can cover via the power of blogging. With the growth of the net, blogging, and social networking, your subscribers expect and receiving information you cannot deliver.

Second, you don't understand blogging and social media. The time and money you'll put into it is not going to offer you the same return as partnering with new media legal publishers and harnessing the power of user generated content to complement your existing publications and reports.

New clues as to why some older people may be losing their memory

ScienceDaily (Dec. 29, 2011) ? New research links 'silent strokes,' or small spots of dead brain cells, found in about one out of four older adults to memory loss in the elderly. The study is published in the January 3, 2012, print issue of Neurology?, the medical journal of the American Academy of Neurology.

"The new aspect of this study of memory loss in the elderly is that it examines silent strokes and hippocampal shrinkage simultaneously," said study author Adam M. Brickman, PhD, of the Taub Institute for Research on Alzheimer's Disease and the Aging Brain at Columbia University Medical Center in New York.

For the study, a group of 658 people ages 65 and older and free of dementia were given MRI brain scans. Participants also underwent tests that measured their memory, language, speed at processing information and visual perception. A total of 174 of the participants had silent strokes.

The study found people with silent strokes scored somewhat worse on memory tests than those without silent strokes. This was true whether or not people had a small hippocampus, which is the memory center of the brain.

"Given that conditions like Alzheimer's disease are defined mainly by memory problems, our results may lead to further insight into what causes symptoms and the development of new interventions for prevention. Since silent strokes and the volume of the hippocampus appeared to be associated with memory loss separately in our study, our results also support stroke prevention as a means for staving off memory problems," said Brickman.

The study was supported by the National Institutes of Health.

CBM Florida Holding Company Enters Into Definitive Agreement To Acquire The Palm Bank

LAKEWOOD RANCH, Fla., Dec. 26, 2011 /PRNewswire/ -- Trevor Burgess, the Chief Executive Officer of CBM Florida Holding Company, and Robert Covington, the Chief Executive Officer of The Palm Bank, announced today that Community Bank & Company ("Community Bank"), has entered into a definitive agreement with Palm Bancorp, Inc. and its subsidiary, The Palm Bank ("Palm Bank"), for the acquisition of The Palm Bank based in Tampa, FL. Walgreen 1Q profit drops on Express Scripts fight (AP)

NEW YORK ? Drugstore operator Walgreen Co.'s fiscal first-quarter earnings fell more than 4 percent due in part to a slow flu season and its decision to leave the Express Scripts Inc. pharmacy network next month.

Walgreen said it would consider a reasonable offer from Express Scripts but reported no progress in negotiations. A three-year contract between the companies ends Dec. 31, and since June, Walgreen and Express Scripts have said they were preparing to stop doing business, jeopardizing billions of dollars in sales for Walgreen.

Shares of Walgreen fell $2.05, or 6.1 percent, to $31.45 in premarket trading.

The nation's largest drugstore chain said the decision to stop doing business with Express Scripts cost a penny per share in sales at pharmacies open at least a year and a penny per share in expenses during the quarter.

The drugstore chain also said a delay in the cough, cold and flu season hurt earnings by another penny per share. The company administered 5 million flu shots through Nov. 30 compared with 5.6 million a year ago.

Walgreen said Wednesday net income fell to $554 million, or 63 cents per share, from $580 million, or 62 cents per share, a year ago, when it had more shares outstanding. Revenue grew 4.7 percent to $18.16 billion.

Analysts surveyed by FactSet expected, on average, earnings of 67 cents per share and $18.24 billion in revenue.

The Deerfield, Ill., company gets $5.3 billion in annual revenue from Express Scripts, which pays Walgreen and other drugstores to fill prescriptions. But it said it would rather give up that revenue than continue filling unprofitable prescriptions.

"While we remain open to any fair and competitive offer from Express Scripts, we firmly believe that accepting their proposal was not in the best long-term interests of our shareholders," Walgreen CEO Greg Wasson said in a statement.

Walgreen is trying to keep as many of those prescriptions as possible by making its own arrangements with companies and health plans. The company says it expects to keep 97 to 99 percent of its fiscal 2011 prescription volume in the new fiscal year, but analysts say Walgreen will lose most of the Express Scripts prescriptions.

Express Scripts also is trying to buy Medco Health Solutions Inc., another large pharmacy benefits manager. If that deal goes through, Walgreen may lose Medco's clients over time.

Walgreen's selling, general and administrative expenses also climbed 5 percent to $4.2 billion because of its acquisition of drugstore.com and other items.

Earlier this month, Walgreen said sales at stores open at least a year grew 2.5 percent during the quarter. However the Express Scripts fight reduced those sales by 1.1 percent. Sales at stores open at least a year are considered a key measurement of retailer health because they exclude results from stores that have opened or closed in the last year.

The company operates 7,812 drugstores nationwide.

Markets get boost after upbeat US jobs figures (AP)

LONDON ? Stock markets bounced back Thursday after upbeat U.S. jobs figures helped shore up sentiment, a day after investors were rattled by the European Central Bank's huge loans to bolster the continent's banks.

As the traditional holiday slowdown began in earnest, investors took heart that the number of initial jobless claims in the U.S. unexpectedly fell 4,000 to 364,000, the lowest level since April 2008. A fairly upbeat U.S. consumer confidence survey from the University of Michigan helped sustain the positive sentiment before the European close.

The figures provided further evidence that the U.S. economy, the world's largest, has gotten through its soft patch earlier this year and may be poised for stronger-than-anticipated growth in the fourth quarter.

However, another U.S. government figure showed that the U.S. economy didn't fare as strongly in the third quarter as previously thought. It said growth was an annualized rate of 1.8 percent, down from the previous estimate of 2 percent.

"Investors appear willing to trade today's downgrade in the rear-view mirror for improving prospects ahead across the labor market into next year," said Andrew Wilkinson, chief economic strategist at Miller Tabak & Co. in New York. "And let's not forget that the anecdotal evidence suggests record holiday spending, which means that fourth-quarter growth is likely to be robust."

In Europe, the FTSE 100 index of leading British shares closed up 1.3 percent at 5,456.97 while Germany's DAX rose 1.1 percent to 5,852.18. The CAC-40 in France ended 1.4 percent higher at 3,071.80.

The euro was also holding its own, trading 0.1 percent higher at $1.3045.

In the U.S., the Dow Jones industrial average was up 0.3 percent at 12,139 while the broader Standard & Poor's 500 index rose 0.5 percent to 1,249.

The optimism in the markets Thursday stood in contrast to developments the previous day, when investors were spooked by the huge size of the ECB's euro489 billion ($639 billion) three-year loans Wednesday to 523 banks. It was the ECB's biggest credit infusion to date as authorities try to steady a financial system under severe pressure from Europe's debt crisis.

Although the loans will help make sure banks have enough money to lend next year, they don't address Europe's underlying problem of too much government debt.

Asian markets traded lower following the previous day's retreats in Europe and the U.S. Investors were hoping that Beijing eases curbs on bank lending and real estate sales to revive slowing economic growth, but analysts expected no immediate changes.

"If expectations of an easier monetary policy do not materialize, the market will remain unstable, but even if some loosening does emerge, the room for gains is still quite limited," said Liu Kan, an analyst at Guoyuan Securities in Shanghai.

Tokyo's main index declined 0.8 percent to 8,395.16 and China's benchmark lost 0.2 percent to 2,186.3. South Korea's Kospi was down 0.1 percent to 1,847.49.

In the oil markets, trading was lackluster with benchmark crude for February delivery up 98 cents at $99.65 in electronic trading on the New York Mercantile Exchange.

Guinness measures world's shortest woman in India (AP)

NAGPUR, India ? An Indian woman was named the world's shortest by Guinness World Records on Friday as she celebrated her 18th birthday in central India.

Jyoti Amge stood just 62.8 centimeters (24.7 inches) tall ? shorter than the average 2-year-old child ? when Guinness representatives visiting from London measured her at a ceremony attended by about 30 family and friends in the town of Nagpur, in Maharashtra state.

A teary-eyed Amge, dressed in one of her finest saris, called the honor an "extra birthday present" and said she felt grateful for being small, as it had brought her recognition.

After receiving a plaque, she and her guests cut a birthday cake.

"I have put Nagpur on the world map. Now everyone will know where it is," said Amge, who dreams of one day becoming a Bollywood film star as well as pursuing a university degree after she finishes high school this year.

She measured 7 centimeters (2.76 inches) shorter than the 22-year-old American Bridgette Jordan, who had held the title since September.

"Jyoti encourages us all to look beyond mere size and to just celebrate our differences," Guinness adjudicator Rob Molloy said.

This was not Amge's first Guinness record. Until Friday she was considered the world's shortest teenager, but in turning 18 qualified for the new title. She has grown less than 1 centimeter (0.4 inch) in the last two years, Guinness said in a statement, and will grow no more due to a form of dwarfism called achondroplasia.

The title of shortest woman in history continues to be held by Pauline Musters, who lived in the Netherlands from 1876 to 1895 and stood 61 centimeters (24 inches) tall.

As markets plunge, Asia's wealthy flock to art (Reuters)

HONG KONG (Reuters) ? In a spacious, luxury apartment perched on the leafy hills of Hong Kong, Kai-Yin Lo browses through a trove of Chinese art acquired over several decades, reflecting how her niche, scholarly pursuit has now hit the mainstream.

Despite giddy Chinese art prices showing some strain from global economic uncertainty, collectors like Lo think values will continue to rise due to limited supply and continued strong demand as Asian collectors become more affluent.

"As East and West get into more of a confluence in taste and in the market place, it will still go up," said Lo, a Cambridge-educated writer and jewellery designer, a slim, elegant woman famously known for wearing mis-matched designer shoes.

She is one of Hong Kong's leading art collectors -- her home is stacked with rare Chinese furniture, stone carvings and paintings, including an inkbrush panorama of the Grand Canyon by Chinese 20th century master Wu Guanzhong.

"These days art investment has entered into the mainstream of investment, especially for younger people. You cannot divorce love of the piece from what lies behind, the value of it."

Hong Kong has played a key role in Asia's art market boom. Its auction market turnover -- anchored by Sotheby's and Christie's -- skyrocketed 300 percent from 2009 to 2010, powered by a wave of Chinese millionaires buying art with avid fervor.

"Hong Kong has became the sales centre of the world," said Patti Wong, chairman of Sotheby's Asia, with revenue in the former British colony on par with New York and London.

Despite the art market's vulnerability to shocks, including the 2008 Lehman Brothers collapse, when unrealistic estimates left scores of unsold lots amid tepid bidding even in the red-hot Chinese ceramics market, Asia's rapid wealth accumulation will likely see more and more money flow into art and alternative investments such as wine.

Asia's wealth management and private banking industry remains a sparkling growth area for many struggling banks, with an estimated 3.3 million high net worth individuals worth more than $1 million, according to Capgemini and Merrill Lynch's latest annual World Wealth report.

With a combined wealth of $10.7 trillion, Asia's wealthy have even eclipsed the $10.2 trillion held by Europe's generational millionaires.

"The exponential growth in the number of emerging market (millionaires) ... is expanding the global market for investments of passion," the report said.

SAFE HAVEN?

While art often comes straddled with hefty commission, storage and insurance costs, it can serve as a fun portfolio diversifier, mixing decent returns with aesthetic pleasure.

Even as the euro zone debt crisis rages and buffets regional stock markets, the Mei Moses Global Art Index, a widely tracked art indicator, showed an 11.8 percent rise in 2011 to November.

"It may not be a good time for sellers but it's an excellent time for buyers. During late 2008 and 2009, I highly advised clients to buy," said Bobby Mohseni, director of MFA Asia, an art consultancy. "With Chinese contemporary art, some prices have gone exceptionally high and that's just over a decade ... so it's best to look at upcoming or mid-tier artists."

While stocks on the S&P 500 have outperformed Western art over the past 25 years, according to Mei Moses data, top Chinese and Asian art is still comparatively cheap compared with Western impressionists or American contemporary art. A Mei Moses index for traditional Chinese art showed a 24 percent jump in the first three quarters this year.

"The confidence in the Chinese contemporary art market remains high despite art market confidence dropping sharply in the U.S. and European contemporary market," Anders Petterson, head of art research consultancy ArtTactic, told Reuters.

Even for those with less purchasing muscle, experts say bargains can still be had in less spotlighted categories, including modern Filipino and Indonesian painters, as well as photography, and Chinese snuff bottles, to name a few.

"Collect what other people aren't collecting," said Tony Miller, a former top Hong Kong government official and long-standing collector of scholars' objects and Chinese art. "If you can't afford Qi Baishi paintings and they're going at HK$2 million a throw, well, go for prints."

Qi is one of the masters of inkbrush paintings and his pieces sell for millions of dollars.

Owners of Hong Kong's art galleries, many of them crammed along the winding Hollywood Road in the Central district, say timing is the key.

"If you get good works of art, then without any question it is (a safe haven) but it doesn't have the liquidity. That's the difficulty," said Sundaram Tagore, whose galleries in Hong Kong and the United States feature a stable of culture-bridging artists.

"If you're trying to sell at the wrong time it becomes part of the distressed market but if you're selling at the right time then you could make 100 times more, maybe more than property or any bonds can provide you."

The search by Asian investors for alternative assets has extended beyond art into wine, gems, watches, postage stamps and other memorabilia -- the rarer and more exclusive, the better.

With about two-thirds of the world's stamp collectors in Asia, the stamps and collectibles market has surged, says Geoff Anandappa of stamp and memorabilia retailer Stanley Gibbons.

Hong Kong-based InterAsia Auctions -- which specialises in Asian stamps -- broke world records for Chinese stamps in September, raking in $12.6 million over four days. A 1941 Dr Sun Yat-Sen inverted centre stamp fetched $221,000, up 66 percent from a similar sale a year ago.

Chinese and Asian buyers have cornered the fine wine market, with a Hong Kong Acker Merrall & Condit wine auction in December bringing in $9 million, including a single superlot of 55 Romanee Conti vintages that fetched a record-breaking $813,000.

Similarly, Asian buying is behind the boom for diamonds and gems. China is on course to become the world's top diamond buyer and retailers in Hong Kong report a rise in the number of men coming to buy loose diamonds for investments.

A Hong Kong jewellery retailer recently raised $2 billion in one of the city's biggest initial public offerings this year to fund expansion in the region.

"It's not the old days of 'safe as houses', put your money in the bank and that will sort you out," said Jon Reade of the Art Futures Group, a Hong Kong-based art investment firm.

"Those are the days probably of my parents' generation ... people are getting more creative with their money."

BETHLEHEM, West Bank ? Hundreds of Palestinians have gathered in Bethlehem to light a Christmas tree ahead of the holiday festivities in the town where Jesus was born.

Palestinian Prime Minister Salam Fayyad pressed a button lighting up the decorations on the 50-foot (15-meter) tree Thursday, along with the lights illuminating the rest of the square outside the Church of the Nativity.

Christmas brings the world's attention every year briefly to this West Bank town south of Jerusalem.

Fayyad said Christmas was an opportunity to "celebrate the Palestinian identity of Jesus Christ."

Peru judge grants Berenson NY holiday (AP)

LIMA, Peru ? A Peruvian court is allowing paroled U.S. activist Lori Berenson and her toddler son to travel to New York for the holidays, she and her father said on Friday.

Mark Berenson told The Associated Press by phone from his Manhattan home that Berenson had obtained permission to leave Peru from Dec. 16 to Jan. 11.

"I'm very glad that Peru is respecting its laws and human rights," he said. "As Lori says, if she doesn't come home, let Interpol arrest her."

Lori Berenson was paroled last year after serving 15 years for aiding leftist rebels, but she cannot leave Peru permanently until her sentence ends in 2015.

Her father told the AP on Friday he is "petrified" a negative local reaction to the New York visit could prevent the trip.

"My worry is that there's going to be screaming to stop this," he said. Some Peruvians consider her a terrorist, opposed her parole and have publicly insulted her on the street.

He said that as far as he knew, his 42-year-old daughter was still trying to buy a ticket for herself and son Salvador, who is 2 1/2.

"It's not going to be easy," he said. Flights are heavily booked and prices high at this time of year.

Reached by the AP, Lori Berenson confirmed her court permission by a text message but added: "I am not speaking to the press."

She has been repeatedly hounded and mobbed by Peruvian news news media, which has occasionally frightened young Salvador. Last month, one TV channel obtained her new address and showed video of her home on television, her father said.

"It was very dangerous," he added. "The (U.S.) Embassy complained."

His daughter is separated from Salvador's father, Anibal Apari, whom she met in prison and who serves as her lawyer.

He also confirmed the court's approval of the New York trip to Peruvian TV reporters on Friday.

Mark Berenson, 69, said his daughter is looking forward to seeing relatives she hasn't met since her 20s, including his 96-year-old aunt.

Since her initial parole in May 2010, Lori Berenson repeatedly expressed regret for aiding the rebel Tupac Amaru Revolutionary Movement.

Arrested in 1995, the former MIT student was accused of helping the rebels plan an armed takeover of Congress, an attack that never happened.

A military court convicted her the following year and sentenced her to life in prison for sedition. But after intense U.S. government pressure, she was retried in civil courts in 2001 and sentenced to 20 years for terrorist collaboration.

Berenson was unrepentant at the time of her arrest, but softened during years of sometimes harsh prison conditions, eventually being praised as a model prisoner.

Yet she is viewed by many as a symbol of the 1980-2000 rebel conflict that claimed some 70,000 lives. The fanatical Maoist Shining Path movement did most of the killing, while Tupac Amaru was a lesser player.

Berenson has acknowledged helping the rebels rent a safe house, where authorities seized a cache of weapons. But she insists she didn't know guns were being stored there. She denies ever belonging to Tupac Amaru or engaging in violent acts.

In an interview with the AP last year, Berenson said she was deeply troubled at having become Peru's "face of terrorism."

Its most famous prisoner, she also became a politically convenient scapegoat, she said.

Christian Bale scuffles with Chinese activist's guards

BEIJING?-- "Batman" star Christian Bale was roughed up by?security guards who stopped him visiting a blind activist living under house arrest in China.

Video footage of the scuffle was shot by a camera crew?traveling with the Hollywood actor as he promoted a film he has made in the country.


CNN posted scenes of the confrontation between Bale and the guards on its website Friday.

The run-in and publicity is likely to cause discomfort in China's government-backed film industry, which hopes Bale's movie "The Flowers of War" will be a creative success at home and abroad.

The star's actions are sure to focus attention on the plight of Chen Guangcheng, guarded around the clock by plain-clothed and uniformed workers who have blocked dozens of reporters and fellow activists trying to see him in the past.

Bale was to leave China on Friday and his representatives could not immediately be reached for comment.

Bale, who won a best supporting actor Oscar for last year's "The Fighter," traveled Thursday with a crew from CNN to the village in eastern China where Chen, the blind lawyer, lives with his family in complete isolation.

They were stopped at the entrance to Dongshigu village in Shandong province by unidentified men.

'An inspiration'
The video footage shows Bale asking to see Chen, with a CNN producer providing interpretation, but being ordered by one of the guards to leave. He then asked why he was unable to pass through. The guards responded by trying to grab or punch a small video camera Bale was carrying.

"What I really wanted to do was to meet the man, shake his hand and say what an inspiration he is," Bale was quoted as saying by CNN.

Chen's case has been raised publicly by U.S. lawmakers and diplomats, including Secretary of State Hillary Rodham Clinton, all to no response from China.

CNN said Bale first learned of Chen from news reports when he was in China filming "The Flowers of War," China's official submission this year for best foreign language film Oscar.

"Chen Guangcheng is a newsworthy figure ... and as such it is in the interest of CNN's global viewers to hear from him," CNN said in a statement. "Mr. Bale reached out to CNN and invited us to join him on his journey to visit Chen."

Chen, a self-taught lawyer who was blinded by a fever in infancy, angered authorities after documenting forced late-term abortions and sterilizations and other abuses by overzealous authorities trying to meet population control goals in his rural community. He was imprisoned for allegedly instigating an attack on government offices and organizing a group of people to disrupt traffic, charges his supporters say were fabricated.

Although now officially free under the law, he has been confined to his home in the village eight hours' drive from Beijing and subjected to periodic beatings and other abuse, activists say.

While Bale's visit focuses new attention on Chen's case, CNN's role raises questions about activism and advocacy among reporters, said David Bandurski, editor of the China Media Project website at the University of Hong Kong.

"It made me instantly uncomfortable, wondering how it all came together. It raises questions about where the lines are drawn," Bandurski said.

Politically sensitive subject
The incident also drew strong interest ? most of it highly positive ? on social networking sites such as Twitter and its Chinese equivalent, Weibo.

Having their star's name pinging across the Internet in connection with such a politically sensitive subject puts promoters of "The Flowers of War" in a bind. The film opens in China on Friday and next week in the United States.

Directed by the renowned Zhang Yimou, it is also the most expensive Chinese movie ever made, at $94 million, some of which came from the state-owned Bank of China.

The movie centers on the 1937 sacking of the eastern city of Nanjing, a central event in China's pre-revolutionary "century of humiliation" and has been described by some critics as hewing to official propaganda portraying Chinese as heroic victims and Japanese as one-dimensional cartoon villains.

While China has the world's third-largest film industry ? both in box office and output ? it has made relatively little global impact. Story lines are often heavily influenced by the ruling Communist Party, whose culture commissars must approve scripts and have final say over whether a film gets released.

Retail sales rises for sixth straight month (AP)

WASHINGTON ? Americans spent more on autos, furniture and clothing during the start of the holiday shopping season, boosting retail sales for the sixth straight month.

The Commerce Department says retail sales rose 0.2 percent in November. The modest gain was lower than October's, which was revised higher to show a 0.6 percent increase.

Sales rose at electronics and appliance stores, auto dealers, clothing stores and department stores. But sales fell at building materials stores, gas stations, and grocery stores.

Consumer spending has rebounded since the summer. That drove economic growth higher in the July-September period.

Nintendo: 3DS gets boost from Mario, at least in Japan (Reuters)

TOKYO (Reuters) ? Sales of Nintendo Co Ltd's 3DS games device will hit 3 million units in the Japanese market within days, but consumers in the U.S. and Europe seem to be delaying their holiday season shopping due to poor economic conditions, the company said.

Nintendo slashed the price of the 3DS by about 40 percent in August and announced a flood of new software, including titles in the much loved Mario series, in a bid to prop up sales of the gadget, which had slumped soon after its February launch.

As a result, the Kyoto-based firm expects to sell 4 million of the machines in Japan within the first year, compared with a worldwide target of 16 million units by March 2012.

"It has regained its momentum," President Satoru Iwata told the Nikkei business daily in an interview, the content of which was confirmed by a company spokesman.

But slashing the price was a painful step for the games giant, resulting in losses on each 3DS unit it sells.

"Even though the penetration rate will grow this year, they are bleeding money and therefore overall from an earnings perspective we are not too optimistic," said Nanako Imazu, an analyst at CLSA in Tokyo, who forecasts full-year sales of 15 million units, due to economic woes in North America and Europe.

BLACK FRIDAY

In the United States, Nintendo's largest single market, the year-end gift-buying rush appears to be starting about two weeks later than usual, Iwata said, but added that sales of new Mario software had started off stronger than in Japan.

Last week Reggie Fils-Aime, president of Nintendo America had told a Reuters Summit he was focusing on maintaining the momentum after a strong showing on Black Friday, which traditionally kicks off the holiday shopping season in the United States.

The Wii home console sold 500,000 units on Black Friday, Fils-Aime said, while Microsoft said it sold 960,000 Xbox consoles in the week of Black Friday, its best week of sales ever.

But a survey published this week showed 38 percent of U.S. consumers had already completed their holiday shopping by the first weekend of December, boding ill for consumer technology firms at what is normally their most lucrative time.

In the six months to September, Nintendo made about 34 percent of its sales in the Americas and 37 percent in Europe, meaning it was hit particularly hard by the yen's rise against both the dollar and euro.

That, along with the price cut, was one of the reasons why the company slashed its forecast to a 20 billion yen net loss for the year to March 2012. Nintendo has begun a small amount of euro-based procurement to try to offset foreign exchange losses, the spokesman said.

Romney attacks Gingrich as Washington insider (AP)

WASHINGTON ? Presidential candidate Mitt Romney stepped up attacks on rival Newt Gingrich Friday, labeling Gingrich as a Washington insider who is unlikely to win the Republican nomination.

In an interview on "Fox & Friends," Romney repeatedly pointed to Gingrich's decades of service in the House of Representatives and elsewhere in government.

"I must admit that Newt has had a very extensive, long record of working in Washington with various governmental and non-governmental agencies, and I just don't think that's the background that's ideally suited, one, to replace (President) Barack Obama, and number two, to lead the country," Romney said. "This is not a matter of that America needs better lobbyists, or better deal-makers, better insiders ? I think America needs a leader."

Romney also disputed Gingrich's claim that Gingrich would win the nomination.

"I'm going to be the nominee," Gingrich said Thursday in an interview with ABC.

When asked if he disagreed, Romney said: "I sure do."

"Let me tell you, over the last year, they've been a lot of people that have been real high in the polls that are not high in the polls anymore," Romney said. "So you know there's this funny thing in America, it's called the election, and to win the election, you've got to earn it."

Romney offered his own prediction. "I'm confident that this will be a successful campaign," he said. "Self-aggrandizing statements about polls are not going to win elections."

The comments represent Romney's most aggressive attacks yet on Gingrich, who has risen in national polls in recent weeks and is currently viewed as the chief conservative alternative to Romney. And while Romney has seen others conservative candidates rise, only to fall back, Gingrich is already a national figure with significant policy expertise ? and there is less than a month before voting begins in Iowa, leaving Romney less time to attack.

Romney's comments came a day after Gingrich said he wanted to stay above-board, telling The Associated Press while campaigning in Iowa, "I'm not going to focus on Romney or anybody else." He made the comment just days after saying in South Carolina that he was "a lot more conservative than Mitt Romney" and added: "It's wrong to go around and adopt radically different positions based on your need of any one election."

(AP) ? By the time Arkansas authorities took country singer Mindy McCready's 5-year-old son from her and into custody on Friday evening, one thing had already become apparent to much of America: McCready's life has come to resemble a bad country song.

Since her success in the mid-1990s as a honey-voiced success story out of Nashville, McCready has been increasingly known for her personal foibles instead of her music.

This week's custody battle was the latest in a long saga of personal heartache and brushes with the law.

Florida Department of Children and Families spokeswoman Terri Durdaller said in an email Friday night that her agency was working with Arkansas state officials to bring McCready's son, Zander, back to his maternal grandmother in Florida. His grandmother has been his guardian since 2007.

Officials say he's safe and in good health.

Gayle Inge, Zander's grandmother and McCready's mother, was tearful when she talked about the news by phone Friday night with The Associated Press.

"I'm real excited that he's safe," she said. "But I can't explain what this is like. We feel for Mindy and we feel for Zander."

Inge said Zander was taken into custody at McCready's boyfriend's lake home in Arkansas. Inge said that her son ? McCready's half-brother ? texted McCready, who responded with a text that said her mother would never see her again.

"I want to wrap my arms around her and tell her that I love her," Inge said, adding that her daughter and grandson were found by authorities "hiding in a closet."

McCready, who turned 36 on Wednesday, did not respond to emails late Friday.

The evening's developments capped a days-long struggle between McCready ? who is seven months pregnant with twins ? and several others, including state of Florida child welfare authorities, a Fort Myers, Fla. judge and her own mother.

Authorities say McCready took the boy during a visit late last month to her father's Florida home, where she was allowed to visit the boy. McCready's parents are divorced.

A Florida judge signed an order Thursday telling authorities to take the boy into custody and return him. It's not yet clear whether the singer could face criminal charges.

McCready said earlier in the week that she would not bring her son back from Tennessee, where she has a home, despite violating the custody arrangement. She told the AP that her son had suffered abuse at her mother's house, a claim that Inge vehemently denies.

"I'm doing all this to protect Zander, not stay out of trouble," McCready wrote in an email to the AP on Thursday. "I don't think I should be in trouble for protecting my son in the first place."

McCready told the AP Wednesday night she was in Tennessee and couldn't travel because she is pregnant with twins.

The boy's father, Billy McKnight, told NBC's "Today" show Friday he spoke on the phone with McCready and their boy after the judge's 5 p.m. EST Thursday deadline expired.

"He did sound healthy and ok. He wasn't crying or scared," McKnight said about their son.

"I think she believes she has a case and doesn't realize she's pushing her luck on this one," he said.

McCready and her mother have had a long custody battle over the boy, who was living with McCready's mother.

"We can confirm that Zander has been taken into custody and we are working with Arkansas state officials to bring him back to his legal guardian in Florida," Durdaller wrote late Friday. "He is safe and in good health.

McCready had provided a series of emails to the AP with Lee County Judge James Seals' ruling to return the boy.

"Mom has violated the court's custody order and we are simply restoring the child back into our custody," the judge wrote. "Nothing more. Nothing less. The court makes no judgment about whether Mom will or will not competently care for the child while in her custody. It only wants the child back where the court placed him."

McCready found fame in the mid-1990s when she moved to Nashville at the age of 18, armed with only her karaoke tapes. Her first album, "Ten Thousand Angels," sold two million copies.

Her next four albums weren't as successful. Her personal troubles began encroaching on her professional success. According to her website, she suffers from severe depression.

McCready fought the release of a tape in which she reportedly talked about former Boston Red Sox and New York Yankees pitcher Roger Clemens, with whom she had an affair as a teenager.

In August, she filed a libel suit against her mother and the National Enquirer's parent company, American Media Inc., over a story published in the tabloid newspaper that quoted Inge.

And in 2008, McCready was admitted to a hospital after police said she cut her wrists and took several pills in a suicide attempt.

During the TV show "Celebrity Rehab 3" in 2010, McCready came off as a sympathetic figure, and host Dr. Drew Pinsky called her an angel in the season finale.

Payroll tax bills defeated in Senate. Now what?

Payroll tax cut measures from Democrats, Republicans go down in Senate. The House is now focus of payroll tax debate over how to stimulate economy.?

Senate defeat of competing Democratic and Republican plans to extend a cut in the Social Security?payroll?tax?has punted the issue to the House, where GOP leaders are facing ideological divisions within the party over whether to pass the?tax?holiday.

The focus is on the GOP-controlled House after Senate votes Thursday exposed wide reluctance by Republicans to go along with the costly proposal ? a centerpiece of President Barack Obama's jobs agenda.

As expected, Senate Republicans defeated Obama's plan to extend the?payroll?tax?cut through the end of next year while also making it more generous for workers.

But in a vote that exposed rare divisions among Senate Republicans, more than two dozen of the GOP's 47 lawmakers also voted to kill an alternative plan backed by their leader, Mitch McConnell, R-Ky., to renew an existing 2 percentage point?payroll?tax?cut.

A spokesman for House Speaker John Boehner, R-Ohio, said Republicans weren't planning on negotiating with Democrats before unveiling a?payroll?tax?cut plan ? and the spending cuts to pay for it ? next week. But the Senate vote would seem to indicate that House Republicans will be hard-pressed to muscle a?payroll?tax?cut through without Democratic support. And those votes could be hard to come by if the GOP plan contains spending cuts Democrats dislike.

Many Republicans and even some Democrats say the?payroll?tax?cut hasn't worked to boost jobs and is too costly with the deficit requiring the government to borrow 36 cents of every dollar it spends.

"I can't find many people who even know that they're getting it, OK?" said Sen. Joe Manchin, D-W.Va., who opposed both plans. "So with that being said, we're going to double down on something that we thought should have worked that didn't work."

Sen. Jerry Moran, R-Kan., said after Thursday night's vote that previous?tax?rebates "stimulated little and increased the debt a lot" and that it would be better to simply cut spending than turn around and use spending cuts on stimulus-style?tax?cuts.

The defeat of the competing Senate plans came as Boehner said for the first time that renewing thepayroll?tax?cut would boost the lagging economy. Boehner also promised compromise on a renewal of long-term jobless benefits through the end of 2012.

The?payroll?tax?cuts and unemployment benefits are at the center of a costly, politically-charged year-end agenda in which Democrats seem poised to prevail in renewing a?tax?cut that many Republicans back only reluctantly. But Republicans are insisting ? in a switch from last year ? that the?payroll?tax?cut and jobless benefits be paid for by cutting spending.

Both parties are seeking the political high ground as next year's elections loom, with Democrats accusing Republicans of siding with the rich, and Republicans countering that Democrats were?taxing?small business owners who create jobs.

The first?payroll?tax?plan to fall was a Democratic measure that was at the heart of the jobs package Obama announced in September. It would cut the Social Security?payroll?tax?from 6.2 percent to 3.1 percent next year and also extend the cut to employers, with its hefty $265 billion cost paid for by slapping a 3.25 percent surtax on income exceeding $1 million.

Republicans and a handful of Democrats combined to kill the measure on a 51-49 tally that fell well short of the 60 votes required under Senate rules. For the first time, a Republican, Susan Collins of Maine, voted to support the millionaires' surcharge.

In a surprising result, Democrats and more than two dozen Republicans then voted 78-20 to kill the $120 billion GOP alternative that would have simply extended the existing 2 percentage point?payroll?tax?cut, financed by freezing federal workers' pay through 2015 and reducing the government bureaucracy.

Republicans offered a simple one-year continuation of the existing law, jettisoning Obama's call to deepen the cut to 3.1 percentage point on workers' first $106,800 in earnings, while expanding it to cut in half employers' Social Security contributions for their $5 million in?payroll.

To pay for the measure, Senate Republicans proposed freezing federal workers' pay through 2015 ? extending a two-year-freeze recommended by Obama ? and reducing the bureaucracy by 200,000 jobs through attrition.

The Democratic plan would give a worker earning $50,000 a more than $1,500?tax?cut; the GOP plan would provide a $1,000?tax?cut for such an earner. A two-income family making $200,000 would reap a $6,000-plustax?cut under the Democratic plan and a $4,000?tax?cut under the GOP version.
